Canada's S-211 Act: supplier register and annual report

A hundred and eighty suppliers across eleven countries, an annual report heading to fill in without making anything up, a deadline approaching while no supplier ever contacted has been followed up: a company required to produce this report faces a mapping exercise a spreadsheet does not hold up for long. This application organises the supplier register, the due-diligence questionnaires and the annual report, without ever deciding for you whether the company is caught by the Act.

Who the application is for

For Canadian companies, or companies linked to Canada, concerned by the federal Act against forced labour and child labour in supply chains — procurement, compliance, governance. Whether the Act applies remains for the company and its legal counsel to establish: the application helps document the finding, it does not decide it.

What the application does

  • Runs the Act's six numerical comparisons (assets, revenue, average employee count, over two financial years) and produces a dated finding — never a conclusion that the Act applies.
  • Prepares the annual report under the legal headings, with the governing body's approval, its signature, publication and submission recorded.
  • Keeps a log of events that can no longer be edited or deleted, whatever the role of the person signed in.
  • Keeps a supplier register with their tier in the chain, their country of production and a dated, reasoned risk level.
  • Compares the risk level set for a supplier with the one set for its country, and flags a gap, without ever correcting either one for you.
  • Tracks due-diligence questionnaires sent to suppliers, with their deadlines, their follow-ups and the list of suppliers never contacted.
  • Inserts a dated overview from the register into the report, for you to review, and prepares a revision when a correction must be documented.

Day to day

  1. Enter your assets, revenue and average employee count for the last two financial years; the application produces the section 2 finding.
  2. Write up the seven headings, have the report approved and signed by the governing body, then record its publication and submission.
  3. Complete the supplier register with their tier, their country and a reasoned risk level; fill in the country-risk table yourself with your own sources.
  4. Send your due-diligence questionnaires, follow them up, then record the answers or close a questionnaire that got no reply.
  5. Before the deadline, insert the overview into the report, review it and complete it before it is approved.

What the application does not do

  • It does not file anything with the relevant Canadian federal body: no official filing interface exists as yet, and the online form still has to be filled in by you.
  • It does not provide any country-risk list: the table is shipped empty, for you to fill in with your own sources.
  • It does not provide the Minister's official questionnaire: the model supplied is built on the Act's headings, it is not that questionnaire.
  • It never concludes on whether your company is caught by the Act or whether your report is adequate: that assessment remains for your company and its legal counsel.
  • It has not yet been put through a real, full filing: only automated tests have checked it so far.

Free and full editions

The free edition produces the section 2 finding, prepares the seven headings of the annual report with approval, publication and submission recorded, and keeps the sealed event log. The full edition installs on top without losing anything, and adds the supplier register with its risk level, the country table for you to source, the due-diligence questionnaires, the overview inserted into the report, its revision and the deadline alert.

Getting started

Gather the assets, revenue and average employee count for your last two financial years, then list your suppliers with their tier in the chain and their country of production. Choose your own sources to assess country risk before filling in the table provided for that purpose.
